Marriage requirements

Australia has straightforward marriage laws for both residents and international couples. A Notice of Intended Marriage must be lodged with an authorized celebrant at least one month and one day before the wedding, though it can be submitted up to 18 months in advance. Both partners must provide valid passports or birth certificates, and any previously married partner must provide a decree absolute or death certificate. There is no residency requirement. Ceremonies must be performed by a registered celebrant β€” either a civil celebrant or an authorized religious celebrant. Two witnesses aged 18 or older are required. The ceremony must include certain legal vows prescribed by the Marriage Act 1961, though celebrants can incorporate these naturally into personalized ceremonies. Same-sex marriage has been legal in Australia since December 2017.
